GENERAL TERMS AND CONDITIONS OF SALE AND USE Preamble These General Terms and Conditions of Sale and Use, hereinafter the ‘Terms’, govern the contractual relationship between Cap Connect SARL-AU, registered with the Tangier Commercial Register under number 68997, with its registered office at Avenue Louis Van Beethoven, Léonore Offices, B25, 90000 Tangier, Morocco, hereinafter ‘Cap Connect’, and any natural or legal person, consumer or professional, private or public, who orders, uses or renews a service offered by Cap Connect, hereinafter the ‘Client’. Cap Connect provides, in particular, domain name registration, transfer and renewal, web hosting, professional email, servers, SSL certificates, licences, and other web solutions and related services. Any order, use, activation or renewal of a service implies full acceptance of these Terms. The Client declares that they have read these Terms before placing an order and acknowledges that they are binding upon them. These Terms prevail over any conflicting or different terms issued by the Client, unless Cap Connect expressly agrees otherwise in writing. Article 1 — Definitions For the purposes of these Terms, the following terms have the meanings set out below: Client: any natural or legal person who orders, uses or renews a service from Cap Connect. Client Account: a personal area created on Cap Connect’s platform through which the Client can manage their services, invoices, contact information and support requests. Service: any product or service supplied by Cap Connect, including domain names, web hosting, email services, SSL certificates, servers, licences, technical work and additional services. Registrant: the natural or legal person in whose name a domain name is registered. Registry: the organisation responsible for managing a domain name extension. Third-party provider: an external supplier from whom Cap Connect may order, activate or resell certain products or services. Client Data: files, databases, emails, content, scripts, applications, and personal or business information stored or transmitted when using the services. Article 2 — Client Account 2.1 Client Account owner The primary email address and contact information entered in the Client Area are essential elements used to identify the account owner. The account owner controls the services associated with the account, including domain names, hosting, email services, servers, licences and other supplementary services. The Client undertakes to provide accurate, complete, genuine and up-to-date information. Fictitious, inaccurate, impersonated or incomplete information is strictly prohibited. Cap Connect reserves the right to suspend, restrict or terminate any account containing false, incomplete or unverifiable information. The legal registrant of a domain name registered with Cap Connect is either the account owner by default or the contact designated as the registrant when the domain name is registered. 2.2 Accuracy of information The Client warrants that the information supplied to Cap Connect is accurate and that they have the legal capacity to enter into the contract, either on their own behalf or on behalf of the legal entity they represent. The Client is solely responsible for the consequences of incorrect, outdated or incomplete information, including suspension, deletion, refusal of registration, loss of a domain name, inability to renew or transfer, or failure to receive notifications. 2.3 Updating information The Client must keep all information associated with their account up to date, including their email address, telephone number, postal address, company name, tax identifier, ICE, RC, CIN or any other required identification information. Any notification sent to the Client Account’s primary email address is deemed validly delivered. 2.4 Additional contacts and subaccounts The account owner may add authorised additional contacts or subaccounts. For a contact to request technical, administrative or commercial changes, they must be configured as a subaccount with the necessary permissions. An additional contact who is not configured as a subaccount may have limited permissions and may not request sensitive changes relating to the account, services, domain names or billing. 2.5 Transfer of the Client Account A transfer of ownership of a Client Account may be requested through Cap Connect support. Cap Connect may require proof of identity, authorisation or representation before carrying out a transfer request. Cap Connect reserves the right to refuse or suspend a transfer request in the event of legitimate doubt, a dispute, conflicting information, insufficient supporting documents or a risk of fraud. 2.6 Account closure or inactivity A Client Account may be marked inactive when no active service is associated with it. The Client may retain access to their account to view order, invoice or service history, or to order new services. Cap Connect may close or restrict an account that is inactive, fraudulent, non-compliant or used in breach of these Terms. Article 3 — Orders, activation and payment 3.1 Orders Any order placed with Cap Connect is subject to validation, payment and, where applicable, verification of the information supplied by the Client. Cap Connect reserves the right to refuse, suspend or cancel any order in the event of non-payment, inaccurate information, suspected fraud, regulatory non-compliance, abuse, technical impossibility, or refusal by the registry or third-party provider concerned. 3.2 Payment Activation of a domain name, hosting, email service, SSL certificate, server, licence or other service depends on Cap Connect actually receiving payment. The applicable prices are those displayed on Cap Connect’s website, in the Client Area, on the pro forma invoice, quotation or any commercial document supplied to the Client before payment. Unless otherwise stated, services are payable in advance. Business Email is payable annually and per mailbox. Monthly prices shown are equivalents of the annual rate to make comparison easier; they do not constitute a monthly payment offer. The annual total is stated before ordering and on the quotation or invoice. 3.3 Setup fees Certain services may require setup, configuration, migration or technical intervention fees. These fees are stated in the service description, quotation or pro forma invoice. Setup and intervention fees become payable once the corresponding work has started or has been performed. 3.4 Recurring services Domain names, hosting, email, servers, licences and other subscriptions are generally recurring services. The Client must pay renewal fees before the due date to avoid suspension, expiration, deletion or interruption of the service. Non-payment by the due date may result in automatic suspension of the service, without Cap Connect being liable for the direct or indirect consequences of that suspension. 3.5 Invoices Invoices and pro forma invoices are made available in the Client Area and may be emailed to the primary contact address or designated billing contact. The Client is responsible for regularly checking their Client Area and emails for due dates, invoices, notifications and alerts relating to their services. Article 4 — Cancellation, refunds and right of withdrawal 4.1 General principle Unless mandatory law provides otherwise, services that have been activated, customised, configured, consumed or supplied by third parties are non-refundable. Refunds are never automatic. Any refund request must be submitted to Cap Connect in writing, through the Client Area or by email to the official support address. 4.2 Business Clients For professional Clients, businesses, public bodies, associations or anyone acting in the course of their professional activity, payments are non-refundable once the service has been activated, ordered from a third-party provider, configured, reserved or delivered. This includes, without limitation, domain names, SSL certificates, email services, licences, servers, VPS, cloud, reseller hosting, technical work, setup fees and customised services. 4.3 Consumer Clients Where the Client acts as a consumer, applicable statutory consumer protection rights remain applicable. However, the Client acknowledges that certain services may be excluded from the right of withdrawal or become non-refundable when they are activated, customised, configured or performed at the Client’s request before the applicable statutory period expires. In particular, the following are non-refundable after activation or ordering from the provider concerned: domain name registrations, renewals or transfers; SSL certificates; software licences; professional email services; VPS, cloud, dedicated or reseller servers; setup, configuration, migration or technical intervention fees; services customised or specially configured for the Client; any product or service supplied by a third-party provider and activated on the Client’s behalf. 4.4 Discretionary refund As a commercial gesture, Cap Connect may accept a refund request submitted within 24 hours of service activation, only where the service does not fall within a non-refundable category and no customised service or third-party product has been activated. Cap Connect reserves the right to accept or refuse any refund request depending on the nature of the service, its activation status, costs incurred and the conditions imposed by third-party providers. 4.5 Refund arrangements Refunds made through PayPal may be credited to the PayPal account used for payment. For other payment methods, including bank card, bank transfer, bank deposit, Wafacash, cash or any other available method, the refund may be credited as a Client balance in the Client Area, usable for future orders. Cap Connect may deduct bank charges, transaction fees, payment gateway fees or costs already incurred with third-party providers where permitted by applicable law. Article 5 — Cancellation of services 5.1 Cancellation by the Client The Client may request cancellation of a service through their Client Area, choosing, where available, immediate cancellation or cancellation at the end of the subscription period. Cancellation of a service does not entitle the Client to a refund of prepaid fees, unless Cap Connect agrees in writing or mandatory law provides otherwise. 5.2 No cancellation fees Cap Connect does not charge cancellation fees. However, fees already paid for the current period, third-party products, setup fees, licences, domain names and customised services remain non-refundable. 5.3 Account access If the Client wishes to cancel a service but cannot access their Client Area, they must contact Cap Connect at support@capconnect.com for the necessary instructions. Cap Connect may request supporting documents to verify the identity or authority of the person requesting cancellation. 5.4 Deletion of data after cancellation When a hosting, email or server service is cancelled, the data associated with the service may be permanently deleted. The Client is solely responsible for backing up their data before requesting cancellation. Cap Connect does not guarantee recovery of data after cancellation, termination, expiration or deletion of a service. 5.5 Cancellation or termination by Cap Connect Cap Connect may suspend, restrict or terminate a service without notice in the event of a breach of these Terms, misuse, non-payment, fraud, a security threat, illegal activity, a legal requisition, a request from a competent authority, or a risk to the infrastructure, other Clients or third parties. No refund, credit or compensation will be due where suspension or termination results from a breach of these Terms. Article 6 — Domain names 6.1 Domain name registration Once a domain name registration has been confirmed by the relevant registry, it is final and cannot be changed, cancelled or refunded. The Client is solely responsible for choosing the domain name, its spelling, the selected extension, the registrant’s information and compliance with third-party rights. Cap Connect does not guarantee that a registration request will be accepted by the relevant registry. Certain extensions may require additional information or documents or be subject to eligibility restrictions. Where a registry, competent authority or third-party provider refuses, suspends, blocks, deletes or cancels a domain because of incomplete, false, unverifiable or non-compliant information, Cap Connect will not be liable and no refund will be due, unless Cap Connect decides otherwise. 6.2 Registrant data The Client undertakes to provide accurate and up-to-date information for every domain name registrant. Cap Connect may request supporting documents to verify the registrant’s identity, legal existence, address, rights or eligibility. Refusal or failure to provide the requested documents may result in refusal of registration, suspension, blocking, deletion, non-renewal or inability to transfer the domain name, without refund or compensation. 6.3 Domain name transfers Domain name transfers may take several days depending on the extension, registry, outgoing provider and applicable rules. Cap Connect cannot guarantee the exact duration of a transfer and does not always have the ability to accelerate the procedure. The Client is responsible for obtaining the transfer code, removing the transfer lock, updating contact information and validating the emails or procedures required by the registry or outgoing provider. Certain country-code or specialised extensions may be subject to particular restrictions, including eligibility conditions, additional fees, specific procedures, longer processing times or transfer limitations. 6.4 Domain name renewal The Client must renew their domain name before its expiration date. Cap Connect may send reminders before expiration, but failure to receive a reminder does not relieve the Client of responsibility for renewal. After expiration, a domain name may stop working, potentially interrupting the website, email, DNS and any associated service. Grace periods, restoration periods, deletion deadlines and applicable fees vary by extension and registry. Cap Connect does not guarantee recovery of an expired domain name. 6.5 Loss or deletion of a domain name Cap Connect cannot be held liable for the loss of a domain name resulting, in particular, from: non-payment by the due date; incorrect or outdated contact details; failure to comply with registry rules; refusal to provide supporting documents; a decision by a registry or an administrative, judicial or regulatory authority; a dispute between the Client and a third party; an error made by the Client when ordering; expiration or deletion of the domain name. 6.6 Specific conditions for registering .ch and .fr domain names For .ch and .fr domain names, the Client is advised to request renewal and pay the invoice at least one month before expiration. This advance notice allows payments, checks and the technical provider’s operations to be processed on time. If a processing deadline earlier than expiration is communicated in the Client Area or in writing, the Client must take it into account. The registry expiration date, invoice due date and renewal processing deadline may differ. The Client must check this information and must not wait until the last few days. Registry redemption or transition periods do not constitute a free extension of service or a guarantee of recovery. For .fr, the registrant must be a natural person resident in the European Union, Iceland, Liechtenstein, Norway or Switzerland, or a legal entity whose registered office or principal establishment is located in one of those territories. The administrative contact must also meet the eligibility requirements. A contact address alone does not make a registrant eligible if they do not meet these requirements. Afnic may check the registrant’s contact details, identity and eligibility, as well as rights to names subject to prior review. Following deletion requested by the registrar, a .fr domain normally benefits from a 30-day redemption period. Certain deletions resulting from proceedings or a competent decision do not benefit from this period. The Client must contact Cap Connect promptly; fees and the possibility of restoration must be checked case by case. For .ch and .li, SWITCH’s terms apply to registrant identity, contact data, operations and disputes. For a .ch domain, at the request of a competent Swiss authority, a registrant without a valid Swiss correspondence address may be required to designate one and disclose their identity within 30 days. After deletion, the registry provides a 40-day transition period during which a third party cannot re-register the name; this period guarantees neither continued DNS operation nor automatic restoration. A person located in Morocco does not become eligible simply by ordering from Cap Connect. The Client must declare the appropriate eligibility category, provide the requested supporting documents and maintain eligibility throughout the registration. EURid — .eu eligibility requirements https://help.eurid.eu/hc/en-gb/articles/9731617172381-Who-can-register-a-eu-or-its-variants-in-other-scripts-domain-name 6.8 .ca and .us domain names: connection with the relevant country The .ca extension requires a Canadian presence under one of CIRA’s categories, including Canadian citizenship, permanent residence, an eligible corporation or ownership of a Canadian trademark under the registry’s conditions. The Client must select a valid category and be able to substantiate it during a check. The .us extension requires an eligible connection with the United States under the Nexus policy, including citizenship, permanent residence, establishment or a genuine presence meeting the registry’s criteria. Anonymous or proxy registrations that prevent identification of the actual registrant are not permitted. Contact-detail protection offered for other extensions must therefore not be assumed to be available for .us. Natural persons must be of legal age. Required identity, tax or registration details must be accurate and verifiable. For .de, DENIC requires accurate registrant and contact details, including a valid physical address. If the registrant is not established in Germany, DENIC may require, within the period specified in its terms, the appointment of a representative domiciled in Germany and authorised to receive official or judicial documents. The Client must comply with checks and the domain’s technical connection requirements. The .nom.es extension is intended for natural persons; .org.es is intended for non-profit entities, institutions or groups. The .es and .com.es extensions have criteria distinct from these categories. The Client must provide the required identifiers and supporting documents and comply with reserved terms and the registry’s transfer and change-of-registrant procedures. Red.es — Registration and .es domain categories https://administracion.gob.es/tu-espacio-europeo/derechos-obligaciones/empresas/inicio-gestion-cierre/derechos/dominios-es 6.11 .cn, .com.cn, .net.cn and .org.cn domain names CNNIC rules provide for verification of registrant information and identity or registration documents. Domain activation and operations may depend on approval of the application. The Client must provide legible documents consistent with the declared information and respond to additional requests. Registering a domain does not replace any authorisations that may be required to operate or host a website in China. CNNIC — .cn domain rules and verification https://www.cnnic.com.cn/IS/CNym/cnymyhfaq/ 6.12 .jp, .sg and .com.sg domain names A general .jp domain name requires a permanent postal address in Japan at which the registrant can be contacted. The Client must ensure they have an eligible address; no local representation service is presumed to be included in the price. For .sg and .com.sg, a foreign applicant must appoint a duly authorised local agent as administrative contact. The .com.sg extension also has requirements relating to the organisation’s activity or status. VerifiedID@SG requires identity and contact verification; for new registrations concerned, this must normally be completed within 21 calendar days, failing which the domain may be suspended. The Client must check the applicable procedure before ordering. JPRS — .jp domain requirements https://jprs.co.jp/en/jpdomain.html SGNIC — Registration rules https://www.sgnic.sg/docs/default-source/policies-and-agreements/rules-of-registration.pdf SGNIC — VerifiedID@SG https://www.sgnic.sg/faq/verifiedid%40sg 6.13 .asia domain names The registrant must meet the rules governing connection to the DotAsia community. Depending on the arrangement used, the requirement is based on a declaration of connection to or presence within that community, or on an administrative contact with an eligible address. The Client must confirm with Cap Connect which arrangement applies to their application and provide the necessary information. DotAsia — Eligibility requirements and applicable arrangements https://www.dot.asia/special-advisory-on-asia-charter-eligibility-requirement-and-idnvariant-policies/ 6.14 .ngo, .ong, .law and .abogado domain names The .ngo and .ong extensions are reserved for non-governmental organisations meeting PIR’s criteria: a public-interest mission, non-profit orientation, independence, genuine activity, structure and compliance with the law. The chosen name must relate to the organisation or its mission. The registry may check status and request supporting documents; an ordinary commercial company must not presume eligibility. The .law and .abogado extensions are subject to verification of status as an eligible legal professional or legal institution under registry rules. The Client must substantiate the required qualifications, authorisations or professional recognition and keep them up to date. Providing consultancy services or holding a degree does not necessarily suffice to meet these requirements. PIR — .ngo and .ong registration requirements https://pir.org/our-impact/ngo-ong-policy/ GoDaddy Registry — .law and .abogado policies https://domains.registry.godaddy/policies .abogado Registry — Eligibility policy https://domains.registry.godaddy/policiespdf/ABGD-POL-001-Eligibility_Policy-1.0.pdf 6.15 Geographic or community domain names Certain extensions, including .nyc, .paris, .melbourne, .sydney and .scot, require a connection to or use consistent with their territory or community. Criteria may be based on residence, activity, culture, a legitimate interest or other connections defined by each registry. They are not interchangeable: the Client must check the policy for the specific extension and must not use a fictitious contact to circumvent a restriction. Evidence, the chosen name and its use may be checked. .nyc Registry — Nexus policy https://www.ownit.nyc/policies City of Paris and Afnic — .paris https://www.afnic.fr/wp-media/uploads/2025/07/250619_CP_Afnic_Paris.pdf GoDaddy Registry — .melbourne and .sydney policies https://domains.registry.godaddy/policies dotScot — .scot policies https://dot.scot/help/ 6.16 .nl and .be domain names: quarantine after deletion SIDN (.nl) and DNS Belgium (.be) normally provide a 40-day quarantine period after deletion. During this period, reinstatement remains subject to registry procedures and may incur fees. It does not constitute an ordinary renewal or a right to keep services active. After release, a third party may register the domain without priority for the former registrant. The Client must request intervention as soon as they notice expiration or deletion. SIDN — Restoring a .nl domain https://www.sidn.nl/en/nl-domain-name/undoing-the-cancellation-of-a-domain-name DNS Belgium — Deletion, quarantine and reactivation https://docs.dnsbelgium.be/be/general/deletes.html 6.17 Other extensions, premium names and special operations Extensions offered in the catalogue may have their own naming, identity, professional-status, use, renewal or transfer rules. Displayed availability does not validate eligibility or definitively confirm registration. Applicable registry terms must be consulted before ordering and when carrying out a subsequent operation. Specific .ma conditions are detailed in Article 7. Reserved or premium names may have registration, renewal or transfer prices different from the extension’s standard rate. The Client must check the actual price quoted for their name before payment, including renewal. A transfer does not always add a year of registration; its effects on expiration vary by extension and operation. The Client must respond to contact-validation requests, maintain a working email address and report changes in identity, status or eligibility. Where a local contact, representation or specific verification service is required, its availability, scope and any cost must be confirmed before ordering. No service intended to circumvent registry rules is included. Grace, restoration or quarantine periods must not be used as the normal renewal deadline. Whether an operation is possible depends on the domain’s actual status and the rules in force at the time of the request; it may be restricted by a decision, dispute, check, lock or deletion that has become final. 6.18 Registry references The links mentioned in the specific conditions above are external links and are not part of CAPCONNECT.COM. They provide access to registry texts and procedures. Mandatory provisions and registry policies applicable to the operation concerned prevail in the event of conflict. The summaries above do not replace those texts; precise processing deadlines for Cap Connect or its providers are those communicated for the domain concerned. Article 7 — Specific conditions for .ma domain names These specific conditions apply to .ma domain names. Mandatory provisions of the regulations in force prevail in the event of conflict with the general terms. 7.1 Obligations and rights of the Applicant/Registrant The Applicant or Registrant acknowledges having read the provisions of the naming decision and agrees to be bound by all its terms, as adopted and amended by ANRT. The decision is available on ANRT’s website. The Registrant benefits from exclusive and personal use of the registered domain name during its validity period, in accordance with the regulations in force. When registering or renewing a domain name, every Applicant or Registrant is deemed to have accepted ANRT’s collection, storage and processing of their data, and the publication of WHOIS data. The Registrant accepts that ANRT may transmit certain data to competent authorities or a third party in accordance with the legislation in force. The choice, use and operation of a domain name and its associated subdomains are the Registrant’s responsibility. The Registrant must ensure that use of the domain name does not infringe the rights or interests of third parties. The Registrant is represented by a natural person known as the ‘administrative contact’, duly authorised and established in Morocco. If the Registrant is a natural person, they may themselves act as administrative contact. The Registrant acknowledges and accepts that the administrative contact is authorised to act as the Registrant’s agent for registration and management of the domain name. In a dispute between the Registrant and their administrative contact, the Registrant’s position shall prevail. The Registrant must provide CAP CONNECT with their actual postal and electronic contact details and those of their administrative contact. For international clients without an administrative base in Morocco, the Registrant may appoint CAP CONNECT’s Manager, Mohammed Bounda (Avenue Louis Van Beethoven, Léonore Offices N°25, Tangier, Morocco — 0539351542), as administrative contact. By choosing this option, the Registrant certifies that all information provided during registration is accurate, complete and compliant with ANRT requirements. The Registrant must ensure that all information provided to CAP CONNECT concerning domain name registration is accurate, complete and up to date. Any change must be updated immediately. The Registrant must also verify the accuracy of data published in WHOIS and update it promptly through CAP CONNECT. The Registrant may renew their domain name at any time in accordance with the naming decision. On expiration, they must renew during the grace period if they wish to retain it. If renewal fees are not paid, CAP CONNECT may terminate the domain name at expiration. Once the grace period has expired, ANRT deletes the domain name. The Registrant may cancel their domain name before its due date. A cancellation grace period allows them to re-register it. The Registrant may request a change of Provider at any time, subject to the naming decision and this contract. The Registrant may transfer their domain name to another person, subject to compliance with regulatory and contractual provisions. The Registrant undertakes to submit to the alternative dispute resolution procedure and to any ANRT decision concerning the registered .ma domain name. At registration, the Registrant must consult the indicative and non-exhaustive list of reserved terms published by the Registry and verify that they have the required rights and supporting documents if the requested name is a reserved term. Such applications are subject to the conditions and, where applicable, ANRT’s prior review. 7.2 Obligations and rights of CAP CONNECT CAP CONNECT must inform the Registrant of their domain name’s expiration at least thirty (30) days before its due date and allow renewal at any time before or during the grace period. CAP CONNECT must make changes concerning domain names and Registrants in the Registry as soon as they are communicated to it. If a domain name is cancelled, CAP CONNECT must inform the Registrant, specifying the grace period during which the domain can be reactivated. CAP CONNECT must provide Registrants with a website (https://www.capconnect.com) containing its complete and up-to-date contact details and publish any regulatory or procedural changes communicated by ANRT. CAP CONNECT must promptly notify the Registrant of any information or communication received from ANRT concerning them. CAP CONNECT must immediately inform the Registrant of any freeze, blocking or deletion of their domain name decided by ANRT, specifying the reason communicated. At any time and at the Registrant’s request, CAP CONNECT provides, free of charge, the authorisation code or codes for one or more domain names within two (2) working days of receiving the request and disables the locking options applied to the domain name, in accordance with Article 35 of decision ANRT/DG/N°02/2024. CAP CONNECT must assist Registrants with registration, renewal, cancellation and transfer of domain names, and with updating associated information, and provide appropriate support to ensure data compliance. CAP CONNECT must not collect, use or disclose any Registrant data for purposes other than domain name registration and management, in accordance with the laws in force, particularly those concerning personal data protection. 7.3 Alternative dispute resolution procedure Under the naming decision, the rules on the alternative dispute resolution procedure apply to .ma domain names involved in a dispute concerning a distinctive sign protected in Morocco, including a manufacturing, trade or service mark, a company name, a geographical indication or an appellation of origin. These rules govern disputes between a complainant and a respondent. The Registrant agrees, upon registration, to submit to this procedure and comply with applicable decisions. 7.4 Identity verification and supporting documents Cap Connect may request from the Client or registrant any document necessary to verify the registrant’s identity, legal existence, address, representation or eligibility. Depending on the circumstances, these documents may include a CIN, passport, commercial registration, ICE, articles of association, power of attorney, certificate, proof of address or any other document required by Cap Connect, ANRT or the registry. Failure to provide valid, complete and compliant documents may result in refusal of registration, blocking, suspension, deletion, non-renewal or inability to manage the .ma domain name, without refund or compensation. 7.5 ANRT decisions and regulatory references The Client acknowledges that ANRT may take decisions affecting a .ma domain name, including freezing, blocking, suspension, deletion or cancellation. Cap Connect will not be liable for consequences resulting from a decision by ANRT or a competent authority, or from application of the rules governing the .ma domain. Article 8 — Shared hosting 8.1 Definition Shared hosting is a server environment shared by several Clients. Server resources, including processor, memory, storage, input/output, bandwidth, web service, databases and email, are shared between several accounts. 8.2 Activation Shared hosting is activated after payment has been received and the order validated. The Client receives access information by email or through their Client Area. 8.3 Shared resources Cap Connect uses its best efforts to provide a stable and efficient service. However, the Client acknowledges that shared hosting involves sharing resources among several users. Cap Connect may restrict, suspend or migrate an account that consumes excessive resources, disrupts server stability, harms other Clients, generates abuse or poses a security risk. 8.4 Suspension after expiration A hosting service may be suspended from its expiration date in the event of non-payment. The Client may renew the service within the period specified by Cap Connect. If it is not renewed, data may be permanently deleted after the applicable retention period expires. 8.5 Deletion of data After the retention period specified by Cap Connect, files, databases, emails, backups, DNS settings, FTP accounts, email accounts and other data associated with the service may be permanently deleted. Cap Connect does not guarantee recovery of data after suspension, expiration, cancellation or deletion of the service. Article 9 — Servers, VPS, Cloud and dedicated services VPS, cloud, dedicated or reseller server services are supplied according to the specifications stated in the offer, quotation or service description. Unless otherwise stated, these services are non-refundable after activation, reservation, installation or ordering from a third-party provider. The Client is responsible for administration, security, configuration, backups, updates, licences, content and activity generated by their server, unless a specific managed-services agreement has been entered into with Cap Connect. Cap Connect may suspend or terminate any server used for prohibited, abusive, fraudulent, illegal or dangerous activities, or activities affecting the security of the infrastructure, other Clients or third parties. Article 10 — Technical support 10.1 Scope of support Cap Connect provides technical assistance to its direct Clients within the scope of the services ordered. Support is intended, in particular, to help the Client access, use and configure the services supplied by Cap Connect. Unless covered by a specific agreement, support does not include: website development or debugging; fixing scripts, themes, plugins or third-party applications; SEO optimisation; content management; remediating hacks caused by unmaintained applications; advanced configuration of external applications; training in the use of third-party software; direct assistance to the Client’s customers. 10.2 Support channels The Client may contact Cap Connect using the channels listed on the official website, including tickets, email or telephone during opening hours. Cap Connect does not guarantee a resolution time unless specifically agreed in writing. 10.3 Assistance to Clients’ customers Cap Connect does not provide direct assistance to end customers of resellers, affiliates, agencies or Clients with multiple accounts. End customers must contact their direct provider.
